DRYLOC SIDING & TRIM LIMITED WARRANTY

LIMITED WARRANTY

1. Pass Through Warranties: The Dryloc Siding & Trim System is an installation system that incorporates other manufacturers finished products. Dryloc Siding & Trim Systems has received Pass Through Warranty approval from the following manufacturers:

• LP Building Products
• PPG Paint
• CraftMaster Manufacturing, Inc. (CMI)

Manufacturer warranties for LP Building Products, PPG Paint, and CMI can be obtained directly from these manufacturers. Written documentation regarding Pass Through Warranties and their conditions can be obtained directly from Dryloc Siding & Trim (“Dryloc”) and are contained in the Dryloc Installation Manual for authorized Dryloc approved installers.

2. Dryloc’s Limited 30-Year Warranty: Dryloc’s Limited 30-Year Warranty applies to any component that is not covered under a Pass Through Warranty described above. Dryloc warrants to the original purchaser and to any subsequent owner of a structure on which its product is installed that the product will perform as reasonably expected and will resist cracking, peeling, separating, chipping, flaking, or rupturing of the surface for a period of 30 years from the date the application is completed when the product has been stored, handled, applied, finished, and maintained in accordance with Dryloc’s application, finishing and maintenance instructions in effect at the time of application.

Dryloc’s obligation under this Limited 30-Year Warranty is payment of an amount equal to the cost of a similar product less an annual pro rata reduction of 3.33% from the date of installation.

This limited warranty expressly excludes any defect or damage caused by the improper installation of the product or modification or alternation of the product, including but not limited to (1) any installation that deviates from the installation instructions and specifications set forth in The Dryloc Installation Manual; and (2) installation of a custom or add-on part.

This limited warranty expressly excludes any defect or damage caused by or related to (1) condensation in the interior of the structure on which the product is installed, and (2) normal wear usage and deterioration, such as fading or discoloration of exterior components, tears, punctures and soiling.

This limited warranty expressly excludes any damage or corrosion, subsequent to delivery by Dryloc, solely caused by or resulting from the environment, such as acid rain, lightning, airborne fallout, earthquake, freezing, rust, oxidation, windstorm, salt, sand, wind, chemicals in the surrounding air, pollution, salt water, hail, flood, rodent, animal or insect infestation or any other external environmental condition.
3. Limitation of Remedies: In no case shall Dryloc be liable for any special, incidental, or consequential damages based upon breach of warranty, breach of contract, negligence, strict tort, or any other legal theory. Such damages include, but are not limited to, loss of profits, loss of savings or revenue, downtime, the claims of third parties, state or local taxes required on warranty repairs, injury to persons and/or property, and any other damage not otherwise covered under this paragraph.
4. No Other Warranties: This agreement is understood to be the complete and exclusive agreement between the parties, superseding all prior agreements, oral or written, and all other communications between the parties relating to the subject matter of this agreement. No employee of Dryloc or any other party is authorized to make any warranty in addition to those made in this agreement.

5. Disclaimer of Warranty:

THE ABOVE WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WHICH EXTEND BEYOND THE WARRANTY SPECIFIED ABOVE, AND IN NO EVENT SHALL THIS WARRANTY BE DEEMED TO COVER INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND.

6. Venue and Choice of Law: Any claims arising from this limited warranty shall be resolved in the State of Utah and Utah law will apply to any dispute.
